Please review our terms below to familiarise yourself with our policies.

All website users agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

We promise to create keepsakes that are made with soul, heart and by hand. 

Our keepsake creations are carefully designed in our ‘Immeryours’ Studio in Far North Queensland, Australia.

Creating art by hand means that there will always be variations in each creation, such as stone shape and size, colour and metalwork.

All keepsakes are different and unique. We are passionate to create the very best bespoke jewellery that highlights your journey. We try to match your colour choice to our best ability; however, it is impossible to match an existing design 100 %. 

JEWELLERY & ART CARE INSTRUCTIONS

Please read carefully through all care instructions given to you and listed on our website. Immeryours is not liable for damage to the jewellery due to external force, contact with chemicals, excessive contact with water, perfume, lotions, daily wear and tear, scratches and bubbles.

BREASTMILK JEWELLERY

As each breastmilk is unique and many factors play a role in preserving breastmilk, such as diet and medication intake, we promise to replace your breastmilk stone in the rare event your breastmilk stone strongly yellows within the first six months.

Please follow our care instructions for breastmilk jewellery carefully when you purchase one of our creations.

POSTAGE:

Immeryours is not liable for missing or damaged keepsakes due to third party such as Australia Post, Sendle, Fastway or any other courier service. However, all steps are taken to assist in locating a parcel should it be delayed.

Parcels are sent via Australia Post with signature on delivery and estimated arrival times of 7-10 business days within Australia. A signature is required for peace of mind, safety and protection of your valuable keepsake. All parcels are lodged via red Australia Street Box. Customers will be notified of the tracking number and progress of the parcel directly from Australia Post. Please ensure all the information you have entered is correct as Immeryours is not responsible for incorrect deliveries due to input errors. Immeryours will not replace or refund parcels that have been scanned as delivered and are signed for.

Immeryours attends their PO Box at twice a week unless otherwise agreed on.

Overseas buyers are responsible for any incurred additional charges such as GST, VAT or customs duty pending your country’s import laws. It is up to the buyer to be familiar with your state’s import law. We will assist as best as possible should you require further information.

PROMOTIONS, DISCOUNTS AND OFFERS

Immeryours is based in North Queensland, Australia, and therefore AEST (Australian Eastern Standard times) applies. Promotion and discount codes finish at AEST. Please be aware of different time zones within Australia and around the world.

Promotions and discount codes do not apply to individual custom orders.

CUSTOM ORDERS

All individual quotes for custom keepsake designs are valid for 14 days.

Immeryours will create a custom link on our website for a more comfortable and secure purchase process and future order tracking. This link will stay active for 14 days and will be deleted unless otherwise agreed upon. Custom designs need to be paid in full before starting on your keepsake design.

Custom orders, including custom colours and custom colour combinations, are non-refundable and non-exchangeable once you have placed your order. Custom orders may be cancelled within 48 hours of being placed unless requested an express order.

TURN AROUND TIME

As all Immeryours creations are created in a place of peace and respect, the waitlist to have your keepsake made can be anything from 8 weeks to 12 weeks. Generally, we aim to finish your order within eight weeks unless you booked an express service. As all items are handmade, delays can occur due to the nature of the work. 

Immeryours cannot be held responsible for circumstances beyond our reasonable control. This may include (without limitation) shortfalls at source, natural disasters and restraints or delays affecting suppliers or transportation to us. We will endeavour to notify you as soon as possible should these problems occur. 

KEEPSAKE DESCRIPTIONS 

All descriptions, images, and samples of our keepsakes aim to give an approximate representation of the keepsake only.

Natural variations in gemstones are natural as such colour, shade tone, markings, and veining may vary from images provided.

  • You, the customer acknowledges that keepsakes supplied may exhibit: variations in shade, colour, texture, surface, finish, and markings and may contain natural fissures, occlusions, lines, and indentations and may fade or change colour over time;
  • expand, contract, distort, fade, discolour or stain as a result of exposure to sunlight, artificial light, heat, cold, water or weather in general;
  • mark or stain if exposed to certain substances; and
  • be damaged or disfigured by impact or scratching.

RING RE-SIZING

We urge you to measure your ring size correctly as the nature of our work will not always allow us to resize your ring. Immeryours team understands that getting the correct ring size can be tricky, especially when you are not physically present to try the rings on; therefore for an accurate ring size, we offer our clients a complimentary ring sizer that will be mailed out to you. Tungsten, Stainless steel and all channel setting rings can not be resized. 

Please note: You, the customer, are responsible for the return shipping of your order as well as the return shipping fee back to you.

MEMORIAL DIAMONDS

Immeryours is a proud partner of ‘Hearts-In-Diamonds’. The Company provides a rescission period of 7 (seven) business days from the date of signing of the Purchase Order Form and Terms and Conditions. The Purchase Order Form may be cancelled within this time, and the Company will issue a full refund of the prepayment. The Purchaser understands that request for Purchase Order Form cancellation must be made in writing and will be acknowledged by the Company in writing. The full refund will be issued only after the prepayment amount has been cleared. After the rescission period has expired and the Purchase Order Form has been accepted by the Company, the prepaid amount will not be refunded to the Purchaser unless the Company is unable to fulfil the terms of the Purchase Order.

A 50% deposit is required at the time of order. A flexible payment option can be arranged to suit your needs. Full payment is before your precious diamonds is released from the ‘Heart-In-Diamond’ laboratory.

CANCELLATIONS

If you have changed your mind and would like to cancel your order, please contact us as soon as possible via email. 

We will be unable to refund you the full purchase amount if we already started creating your keepsake. 

Workshops bookings are fully refundable seven days prior to the workshop should you be unable to attend.

Should you wish to cancel six days prior to the workshop, a 50% refund will be issued and no refund for less than 24 hr cancellation. You are very welcome to reschedule you are unable to attend.

WARRANTY

In addition to the statutory warranties, our goods come with a limited manufacturer’s warranty for a period of 12 months from the date of purchase covering against defects in material and/or workmanship on all of the goods that we sell. The manufacturers’ warranty may exceed this period of 12 months in relation to some goods.

The twelve-month limited warranty excludes, to the extent permitted in the legislation (including under the Australian Consumer Law):

  • damage due to ordinary wear and tear, misuse, accident, abuse, alteration, substitution;
  • improper repair or warranty service performed by someone other than us or our authorised repairers, theft, disappearance;
  • loss (including lost stones) and/or any other type of use causing deterioration. Loose diamond stones supplied by the Retailer and assembled by someone other than the Retailer or its authorised agents are not covered by the twelve-month limited warranty and Immeryours will not be liable for any such damage.

REFUNDS AND RETURNS 

 

We love what we do! In the rare event that you are not satisfied with your keepsake, we ask that you contact us directly via email, and we will do our very best to achieve outstanding customer satisfaction. Our satisfaction guarantee states that if, for any reason, you are not entirely in love with your keepsake, that you reach out and contact us within three days after receiving the keepsake.

At Immeryours, delivering unique and bespoke jewellery pieces that last is our priority. Each item is made to order, a refund(s) and return(s) for change of mind, incorrect purchases for bespoke, engraved, stamped or customised DNA items with ashes, human hair, fur, breastmilk, placenta, umbilical cord and other biological matter are not permitted. No refunds and returns on keepsakes after customer approval of a keepsake or after Immeryours advised against a chosen design, including colour and material combination. Additional charges may apply should the customer wish to change the design after design approval or after Immeryours advised against a chosen design, including colour and material combination.

All engraved items of jewellery are specifically for final sale and have been engraved according to customer specifications. Immeryours is not liable for errors that are the result of customer instructions or specifications. Under the Australian Consumer Law, small deviations or slight variations from them that do not substantially affect the customer’s use of the Goods will not entitle them to reject the keepsakes or make any claim regarding them.

FAULTY ITEMS AND REPAIRS

Each piece of jewellery has gone through many rounds of quality control before being sent out to a customer. However, manufacturing faults do happen and we always ensure the issue is resolved within a time frame quoted. If you believe the jewellery to be faulty after wearing them, the item can be sent back for appraisal. You must adhere to all care instructions, or we will not honour a refund if the item has been damaged due to negligence on your part. 

If you believe you have received a faulty product, please get in touch with us right away to notify us of the fault and include the below information:

  •  Your invoice #
  • Your full name and address
  • Photographic evidence of the fault along with a brief description

After a careful assessment by a qualified jewellery team, we will advise you of the next step.

Please make sure each jewellery piece that is being returned is packaged safely to avoid damage during transit. Damaged goods due to poor packaging are the responsibility of the sender, and Immeryours can refuse the item and send it back to the customers at their expense. 

Please note that wear and tear and normal use is not considered a fault. Each jewellery piece is delicate and unique in nature and should be handled carefully and accordingly; please refer to Care Instructions and Product Care Information. We encourage you to treat your jewellery with due care, and general wear is not covered by warranty. Although diamonds, gemstones and composite stones are hard they can be broken, chipped, scratched or broken stones are not covered under warranty. Gemstones, diamonds and composite stones that have come loose or lost due to damage are similarly not covered under warranty.

On a case by case basis, some repairs incur a fee, and a quote will be provided for approval before repair(s) can go ahead.

IMPORT DUTIES AND TAXES

Custom charges, duties and taxes are the sole responsibility of the customer and are not included in the cost of the order or shipping charge. Taxes and customs charges vary depending on each country and the value of the item(s). We suggest contacting your local customs office if you are unsure of the applicable taxes and customs fees that may be relevant to you.

Immeryours is not responsible for any additional charges imposed during the import process into the country of recipient’s choice. 

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

You expressly agree that your use of, or inability to use, the service is at your sole risk. Immeryours shall not be liable for any loss or damage where this is due to circumstances beyond the control of Immeryours. 

Immeryours shall in no circumstances be liable to the Client for any loss, claim or liability of whatever nature caused by the acts or omissions of any third party.

The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Immeryours, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally, there may be information on our site or in the service that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including, without limitation, pricing information, except as required by law.
